The Zero Tolerance Law
is a law that is focused on deterring and disciplining
(punishing) those under the legal drinking age of 21.
There are a number of ways which an underage drinker may
lawfully be identified and cited, such as in:

A
traffic stop related to a violation.

Contact at a sobriety checkpoint.

Contact at a crash site
-
Or through consensual contact with the driver.
In any of the above mentioned situations, if at any time
during an interview or review of the individuals drivers
license the officer suspects the driver has been
drinking, the officer is authorized to administer a
Standardized Field Sobriety Tests (SFST).
At this point, the officer must decide if there is
probable cause to make a standard DUI arrest (a BAC of .08 or higher).
If the officer rules out probable cause for a DUI
arrest, they can then determine if a zero
tolerance violation has occurred.
To determine a violation of the zero tolerance law, the
office normally uses Preliminary Breath Test (PBT)
device. If two breath samples produce BACs of .02 or
higher, an arrest for a violation of the zero tolerance
law usually occurs.
